European Alternatives to Mailchimp

Is Mailchimp GDPR compliant? This is a critical question for every EU-based marketer. Mailchimp is owned by Intuit, Inc. — a US corporation headquartered in Mountain View, California. All subscriber data processed through Mailchimp — names, email addresses, purchase history, behavioural data — is transferred to and stored on US servers. Under the CLOUD Act, US authorities can compel Intuit to produce this data without notifying the EU subscribers whose data it contains.

Mailchimp GDPR Germany — formal warnings: in 2021, the Bavarian State Office for Data Protection Supervision (BayLDA) issued formal guidance warning that using Mailchimp for EU subscriber lists requires either explicit informed consent or additional technical and contractual safeguards. Multiple German website operators received formal warnings. The core problem: the Standard Contractual Clauses that Mailchimp relies on are insufficient under Schrems II without supplementary measures.

The Schrems II problem: the 2020 ECJ ruling invalidated Privacy Shield, the legal framework Mailchimp previously relied on for EU-US data transfers. The EU-US Data Privacy Framework (2023) has partially restored a legal basis, but it is already being challenged in European courts by privacy organisations led by Max Schrems. If the framework is invalidated again, all EU organisations using Mailchimp would face immediate GDPR compliance exposure.

What Mailchimp offers for GDPR compliance: Mailchimp provides a Data Processing Agreement, standard contractual clauses, and GDPR-specific features including double opt-in, unsubscribe management, and consent recording. These are meaningful steps, but they cannot solve the structural problem: Intuit is a US company and US surveillance law overrides European contractual protections.
