European Alternatives to Microsoft Teams

Is Microsoft Teams GDPR compliant? Microsoft has invested significantly in GDPR compliance features, including the EU Data Boundary initiative and Standard Contractual Clauses. However, Microsoft Corporation is a US company subject to the Foreign Intelligence Surveillance Act (FISA 702) and the US CLOUD Act. These US laws allow American intelligence agencies to compel Microsoft to produce European customer data — regardless of where it is stored.

Microsoft Teams EU Data Boundary: in 2023, Microsoft introduced the EU Data Boundary, promising that Teams data for EU customers would be stored and processed within the EU. This is a meaningful step but does not resolve the fundamental legal conflict. FISA 702 operates independently of where data is stored — it applies to the company, not the server location. US courts have confirmed this interpretation.

Teams data in practice: all Microsoft Teams messages, files, meeting recordings, transcripts, and call logs are stored in Microsoft's cloud (Azure). Without end-to-end encryption (which Teams does not offer for most use cases), Microsoft and US authorities have technical access to all workplace communications. This is particularly relevant for businesses handling confidential legal, medical, financial, or HR information.

Microsoft Teams GDPR Germany: Hesse was the first German state to formally ban Microsoft Teams in schools, citing GDPR concerns about data transfers to the US (2021). Baden-Württemberg, Bavaria, and other states issued similar guidance for educational institutions. The German Conference of Data Protection Authorities (DSK) has repeatedly flagged Microsoft 365 — including Teams — as problematic under GDPR due to telemetry and US jurisdiction.

European alternatives provide GDPR-by-design compliance. Element (UK, based on the Matrix protocol) is used by the German Bundeswehr and multiple NATO members for secure communications. Wire (Switzerland) is BSI-certified for enterprise security. Stackfield (Germany) provides encrypted collaboration with German data storage. All operate exclusively under EU/Swiss law with no US jurisdiction exposure.
